Personally I think that McCarty is using the passive "old government friend" because he’s much too modest to admit that he thought this up all by his own bad self. It’s nice to know that, should someone ever decide to remake The Great Escape, McCarthy would be willing to play the part of Gruppenführer Artur Nebe… but without the feelings of guilt.

Not a bad idea, but I think Adam Yoshida’s “macrowaves” would be more spectacular.
It will take a while for habeus writs to be issued. When they are, I expect the Bush DOJ to use every delaying tactic at its disposal. The writs will in many cases result in the detainees being freed during the next, likely Democratic, administration. Watch for Republicans to howl that the Democrats are freeing terrorists.
As an aside, isn’t “detainees” a wonderfully euphemistic word? Some of those people have been “detained” for six fucking years. “Detainees” is of a piece with substituting “enhanced interrogation techniques” for “torture” and “extraordinary rendition” for “kidnapping.” The Bush administration’s trashing of the meaning of words gets lost among its greater crimes and yet that may be one of its most long-lasting evils.
If an incoming Obama administration actually puts these guys on trial, isn’t that going to open a Pandora’s box as far as torture and kidnapping? But, Bush and Cheney will be in Paraquay, right?
