A Chinese Muslim at Guantanamo Bay got a small measure of vindication Monday when a federal appeals court announced it had thrown out his designation as an enemy combatant, marking a setback for the Bush administration.
The ruling in favor of Huzaifa Parhat comes in the first of what eventually could be 160 or so such court reviews filed by Guantanamo Bay detainees in the U.S. Court of Appeals for the District of Columbia Circuit.
To be sure, the cases of Parhat and a small number of other Chinese Muslim detainees — known as Uighurs — are a unique sub-category of the cases involving roughly 270 detainee at Guantanamo Bay.
The Justice Department concedes that Parhat never fought against the U.S. and says it has no evidence he was planning to do so.
The case hinges on Parhat’s connection to the East Turkestan Islamic Movement, a militant group that demands separation from China and that the military says has some ties to the al-Qaida terrorist network.
The United States named the East Turkestan Islamic Movement a terrorist group in 2002, a move that some international affairs analysts say was made to appease China and ensure it would not oppose the invasion of Iraq.

If one has a feeling for what imprisonment for even one night is like, snark on this topic is difficult. They were sweeping the streets in Pakistan for chumps to give the Americans for bounty. Cab drivers, students, neighbors, all were fair game. Once in the belly of bushco, release would be an admission of stupidity and question the essence of the administration. I pity these and others we probably will never know about and I pray the the perps are tortured with nightmares for life.
Somehow, I don’t think these people will be having nightmares for life or even a night. It implies the perps have a conscience.
They don’t.
I think back to a punchline that was popular for a few months after 9-11 that seems appropriate now…When our government imprisons and tortures innocent people, then the terrorists have won.
It’s still not funny.
Innocent, schminocent. He’s still not-white, still has a weird sounding name, is not an Xtian — so clearly is not someone we should care much about. And if we don’t have to care, then… who cares, right? I vote Andy M for the Supreme Court. He can have the seat right next to Ted Nugent’s.

I’d love to think that that will lead our wingnut neighbors to concede that it’s OK to release him.
It will not.
Being confined at Gitmo means the person is a priori guilty, does it not? It does if you’re a wingernut.
I’ve heard about the case of these Gitmo Uighurs for many months now, but no outrage seems to build for their release. The first story was along the lines of “gee, these guys are innocent but no government will agree to take them except the one that wants to imprison them, so we’re just letting time march on”. To the Bushco/Cheneycorp minions these people are just one more piece of paper to put into the deal-with-it-later bin. Culture of life, you know?
Clearly, they haven’t been waterboarded enough. Real interrogators would have been able to get them to confess masterminding:

The attack on Pearl Harbor
The Edsel
The failure at the Bay of Pigs

Interesting that this is coming out at this particular time of year. I believe next week we are celebrating the Old Brown Piece of Paper, in which it was declared to be “self evident” that “all men are endowed by their Creator with certain unalienable rights.” Do the whistling anuses on the Right that squeal constantly about “patriotism” remember that at all?
You live in a dictatorship? Want political reform? Don’t be Muslim. The US is happy to lock up foreign dissidents with a whiff of Islam, all in the name of Teh War On Terrah.
